  1. BEL198479 attempted to fill in a protest form prior to the protest time.

  2. The SLO195998 coach was seen to be deliberately distracting and interrupting BEL198479 when he was attempting to write a protest and, when the time limit expired, told him he could not lodge a protest.

  3. When informed of this the jury chairman invited BEL198479 to complete and lodge the protest.


Incident



  1. BEL198479 and SLO195998 approached the windward mark on port tack with BEL198479 overlapped inside at the zone.

  2. SLO195998 tacked to round the mark and BEL198479 had to alter course to avoid a collision before SLO195998 completed her tack.

Conclusion

 

  1. Because the actions of the SLO195998 coach prevented the lodging of the protest within the time limit, there is good reason to extend the time for this protest. (Rule 61.3 - Protest Time Limit)

  2. SLO195998 as a tacking boat did not keep clear of BEL198479 on a tack and thus broke rule 13.
